When jail time for your multiple DUIs is a real possibility

April 23rd, 2015 • drunk driving

If you have been arrested for driving under the influence at least once before, you should know that New York State laws carry harsh punishments for habitual DUI offenders. That's because driving under the influence is an ever present threat to public safety. Unfortunately, New York state legislatures have addressed that threat without fully recognizing that alcohol dependency often plays a significant role in many multiple DUI cases.

According to the Mayo Clinic, alcohol dependency is a chronic and progressive disease. This means that you may have difficulty controlling your drinking or experience withdrawal symptoms when you attempt to stop. Although this may not excuse your decision to drink and drive, alcohol dependency is nevertheless an issue that a court may wish to consider.

Depending on the circumstances of your case, the punishment against you might be better served by requiring you to undergo extensive substance abuse treatment rather than locking you up.

You should also know that just because police arrested you does not necessarily mean prosecutors will be able to prove the DUI charges against you. Things like unwarranted traffic stops or the inaccurate or unreliable chemical testing of your breath, blood or urine may invalidate your arrest altogether.
